General conditions of sale

These general terms and conditions apply to services, orders and shipments of items that you, as a customer, have ordered online on the website of www.cavedelacote.ch. By placing an order, you acknowledge having read, understood and accepted them without reservation.
Cave de La Côte Société Coopérative reserves the right to modify these terms and conditions at any time by publishing a new version on this site. Any order placed after publication by Cave de La Côte Société Coopérative of the new version of the general terms and conditions of sale is deemed to be acceptance of the latter.

By using the www.cavedelacote.ch website, you also agree to be bound by our website terms of use and our privacy policy. Please read them carefully before using the services offered on this site.

When placing an order on the site, you must register. You can open a personal account if you are at least 18 years old. You ensure the accuracy and completeness of the data provided when placing an order and you undertake to update your personal data as soon as possible in the event of a change of address or any other modification. You also undertake to keep the password chosen at registration strictly confidential and not to disclose it to third parties.

You may at any time refuse to receive advertising related to our offers by sending an e-mail to info@cavedelacote.ch or a letter to Cave de La Côte Société Coopérative, Chemin du Saux 5, 1131 Tolochenaz, Switzerland.

All offers from Cave de La Côte Société Coopérative are without obligation. The contract between you, as a customer, and Cave de La Côte Société Coopérative comes into being with your order and its acceptance by the winery. Cave de La Côte Société Coopérative does not sell alcohol to young people under the age of 18.
Your order is made on the Internet, by filling in the order form placed online by Cave de La Côte Société Coopérative. It is made at the prices and indications displayed on the site on the day of the order.
In the event that a product is not available after you have placed your order, we will inform you by email. We will offer you an item of a more recent vintage or a vintage of equal or greater value. You can then decide whether to accept our alternative offer or cancel your order.
Please note that your payment card will only be charged at the time of dispatch. If you decide to cancel your order, your payment card will not be charged.
Cave de La Côte Société Coopérative reserves the right to refuse any order, in particular when

• the amount is greater than CHF 1,000.-
• payment is refused by the bank,
• orders are deemed to be fraudulent,
• in the case of personalised services, the content, text or image is likely to violate a legal provision or to contravene good morals.

Cave de La Côte Société Coopérative delivers in Switzerland only and all orders on www.cavedelacote.ch are limited to Swiss territory. All orders are delivered to the delivery address you have indicated. Responsibility for the goods passes to the customer upon receipt by the carrier.
In order to guarantee you a careful delivery as soon as possible, we have joined forces with La Poste. Your order will be delivered directly to you by your postman. If you are absent at the time of delivery, a notice will inform you that your parcel has been stored at your local post office. You can then collect it from the post office or request a second delivery (please refer to the instructions on the post office notice).
Wines, spirits and accessories: Items in stock are usually delivered within 10 working days.
Gift vouchers: Gift vouchers are delivered by post within 2-3 working days.

You must check the quantity and condition of the goods on delivery. In case of breakage, delivery error or defective goods, you must send a complaint to Cave de La Côte Société Coopérative within 30 days of delivery.
All complaints must be addressed to our Customer Service (email: info@cavedelacote.ch and telephone: 021 804 54 64). In the event of a return of goods, you must first contact our Customer Service Department before sending the product back.
The return postage (standard) will be refunded and credited to your personal account or by bank transfer. Bottles and other items must be returned in their original packaging.
We will arrange to replace defective bottles or refund you in the form of a voucher. For cork tastes, foreign wines bottled in the country of production will not be refunded.

We make every effort to offer our customers products of the highest quality. If you are not satisfied with the goods you have ordered, you have 30 days to report this to our Customer Service. Our consultant will work with you to find a solution.

The prices indicated on the site, as well as the delivery charges, are in Swiss Francs, including VAT. Cave de La Côte société coopérative reserves the right to modify its prices and delivery charges unilaterally or discontinue the availability of an item for sale at any time for any reason and without notice. Conditions and prices are subject to change.

Delivery rates are as follows: Delivery by post or VinoLog: CHF 20.00 / Free of charge for orders of CHF 300.00 or more. Actual costs may be charged for special shipments.

Payment is made either by credit card (Visa, Mastercard), before delivery of the goods, or by invoice payable within 30 days. The credit card details are encrypted to protect the security of the customer.

Your personal data is collected only in accordance with the legal provisions and is processed in accordance with our Privacy Policy. You authorise Swiss Post (or the selected carrier) to communicate your exact address when a shipment cannot be delivered to the address indicated.
In order to provide some of the personalised services, Cave de La Côte Société Coopérative may have to call on the services of third parties. In this case, this third party must at all times ensure a level of protection of the personal data transmitted equivalent to that applied by Cave de La Côte Société Coopérative.

Without limiting the scope of these general terms and conditions of sale, no claim whatsoever for delivered products, non-delivery of products or otherwise may exceed the amount of the purchase price of the products that gave rise to a claim for damages. Under no circumstances shall Cave de La Côte Société Coopérative be liable for indirect, incidental or consequential damages of any kind (even if the occurrence of such damages was known or could have been known by Cave de La Côte Société Coopérative) arising in connection with its products, their use, their sale or this site.

The present general terms and conditions of sale are governed by Swiss law. The place of jurisdiction is Tolochenaz, Switzerland.
